A Booming Market with Hidden Risks

Zhao Zihao, a smart glasses owner from Wenzhou, told Workers’ Daily that recording his fishing trips is far more convenient than pulling out a phone or camera. “The unique value of this product is combining recording with stylish sunglasses for lightweight wear,” he said. He also noted that many short-video creators have adopted smart glasses as efficient content creation tools.

However, the same features that make these devices appealing also create new vulnerabilities. The camera sits close to the wearer’s line of sight, making recording far harder to detect than with a phone. As products become increasingly indistinguishable from ordinary eyewear, the risk of covert recording grows.

The Flight Attendant Incident That Sparked Debate

In June 2026, a passenger on a Spring Airlines flight used smart glasses to secretly film flight attendants during boarding and posted the video online, triggering widespread public concern. The incident, reported by Red Star News, led to a swift response from both the airline and Rokid, the glasses manufacturer. Rokid launched a special rectification, removed infringing content, and committed to increasing “no secret filming” prompts in its products.

One such product had sold more than 6,000 units, marketed with the claim “records without light, no alarm trigger.”

Field tests conducted by Xiaoxiang Morning Herald confirmed the effectiveness of these stickers. Reporters wearing smart glasses with light-blocking film walked through office buildings and convenience stores without anyone noticing they were recording. The recording indicator sound was so faint that even people standing 10 centimeters away could not hear it.

Lu Yutong, a lecturer at Renmin University Law School, told Workers’ Daily that under China’s Civil Code, even in public places, secretly filming someone’s portrait or private activities with smart glasses constitutes an infringement of portrait and privacy rights. The challenge, she noted, lies in detection and evidence collection—victims often only discover they were filmed after images have already spread online.

Legal experts cited by Red Star News and Xiaoxiang Morning Herald emphasized that unauthorized filming and publishing carries civil, administrative, and even criminal liability. Fu Jian, director of Henan Zejin Law Firm, noted that infringement of portrait rights does not require a profit motive—simply filming and publishing without consent is sufficient grounds for civil liability. Wan Qi, a lawyer at Hunan Jinzhou Law Firm, added that sellers of light-blocking stickers could face joint liability for facilitating covert recording.

Beyond protecting those being filmed, experts warn about data security for users themselves. Smart glasses often collect biometric data—including voiceprints and eye-tracking patterns—to power voice assistants and gesture recognition. Under China’s Personal Information Protection Law, these are classified as sensitive personal information requiring specific purposes and separate consent. Lu Yutong noted that current “blanket authorization” agreements used by most manufacturers do not give users the option to consent to different categories of data separately.

Industry Self-Regulation and Regulatory Response

In June 2026, the Ministry of Industry and Information Technology guided the release of the AI Glasses Trustworthy Vision Self-Regulation Convention at the AI Glasses Ecosystem Conference. Lu Yutong called on regulators to establish detailed standards for new smart terminals, including requirements for information collection permissions, recording status indicators, and encryption of sensitive data. She emphasized the need to balance technological innovation with the protection of personality rights.

Content sharing platforms should strengthen authorization verification and takedown mechanisms, while e-commerce platforms should tighten oversight of products designed to circumvent recording indicators. Users entering classrooms, medical facilities, or changing rooms should proactively confirm the rules rather than assuming “public spaces” give them free rein.

The challenge ahead is significant: how to preserve the legitimate benefits of wearable technology while preventing its abuse.
